Maua Power Frame bicycles and accessories are sold by Maua srl (hereinafter Maua Power Frame), with headquarters in via Ottone Rosai 6a, Milan 20151 (MI). Maua Power Frame, through its website www.powerframe. bike (hereinafter Website), manages online and physical sales at the headquarters in Corso Garibaldi 38, Milan.
All goods ordered, sold, purchased and supplied via www.powerframe. bike and in the showroom must be under a sales contract between Maua Power Frame and the buyer.
ACCEPTANCE OF THE TERMS AND CONDITIONS
These General Conditions of Sale (hereinafter Conditions), which may be revised from time to time, apply to the use of the Website www.powerframe. bike. Your use of our Website constitutes your acceptance of and binding to these Terms.
Maua Power Frame reserves the right to change the Terms at any time without notice. We invite you to periodically check the updated Conditions and changes on the web page in the “Terms and Conditions” section; in this way, you will always be aware of what information we collect, how we use it and under what circumstances we disclose it. If you do not accept these terms, you may not use this Website.
If you wish to purchase the products available in the www.powerframe online store. bike is bound to accept these terms and conditions in order to place an order. Your use of our Website constitutes your agreement to accept and be bound by these Terms.
By accepting, you understand and accept the terms and conditions set out in this legal notice. In case of refusal of the conditions covered by this section, it is not possible to process any Maua Power Frame order. YOUR RIGHTS.
Maua Power Frame is based in Italy and complies with Italian law and consumer protection regulations . This means that shopping with Maua Power Frame is safe. Italian law and regulations are applicable regardless of where the buyer is located.
Trademarks: The Website is owned and operated by Maua Power Frame. This Website contains many trademarks and/or logos, trade names, partner company trademarks, service marks, copyrights and may also contain various protected trademarks of Maua Power Frame affiliates. These trademarks remain the property of their respective owners. You acknowledge the nature of these trademarks and understand that you do not acquire, through use of this Website, any right, title or interest in the trademarks. The consumer agrees not to modify, amend and/or exploit the trademarks, nor to participate in any activity that modifies and/or exploits such trademarks. All rights to these trademarks are reserved. Any improper use of trademarks is punishable by law; any use without written authorization is strictly prohibited.
PRODUCT DESCRIPTIONS AND IMAGES
We ensure that all Maua Power Frame product descriptions and images visible on the Website are accurate and up to date.
It may happen that some images may be slightly different from the product delivered with reference to colour, shape and size due to monitor settings.
ORDERS
By placing the order on the Website , the Customer declares to have read the conditions of sale, the proposed payment methods and the entire purchase procedure.
An order is processed only when:
all the data necessary to complete the order have been entered
acceptance of these terms and conditions by the Customer has been confirmed
click on the “Send order” button (or a similar button)
A confirmation message will then appear on the screen.
Until you click the "Submit order" button, you can modify the order and the data associated with it at any time. We reserve the right to accept or refuse an order and such decision is made at Maua Power Frame's discretion. If an order is not processed, we will promptly notify you via email. The confirmation of receipt only certifies that the order has been received by us; It is important to underline the fact that the confirmation of receipt does not represent a purchase contract. Any right of the Customer to any compensation for damages or compensation is excluded, as well as contractual or non-contractual liability for direct or indirect damage to people or things, caused by non-acceptance of the proposed order.
The order confirmation is sent via e-mail only when our systems verify the order. The order confirmation therefore constitutes a purchase contract following which the product will first be processed and then shipped. Only following the order confirmation sent by email will your credit card be charged.
The order confirmation email also contains a tracking number, so that you can independently monitor the progress of your order and your Maua Power Frame.

All Maua Power Frame product orders are subject to product acceptance and availability.
Products available for sale change frequently and we reserve the right to make changes to products without notice. Some of our products may only be available in limited quantities.
All information about our products, including prices, is accurate and up-to-date. However, there may be occasions where the Website contains errors and inaccuracies relating to size, colour, stock availability or other matters, for which we accept no responsibility. We reserve the right to correct errors and update product information at any time. We reserve the right to change prices at any time.
The prices displayed on the Website are in euros or pounds sterling, including VAT. The VAT due will be clearly separated from the total price and indicated at the time of purchase.
Transport costs, to be paid by the Customer, will be clearly indicated at the order stage.
PAYMENT
Different payment types are available:
Payment by credit and debit card
Advance payment via SEPA bank transfer

Maua Power Frame accepts payments via credit and debit cards (Visa, Mastercard, Diners, American Express, JBC), through the Stripe banking gateway. The data relating to the credit card used by the Customer are in no way known to Maua Power Frame but reside exclusively on Stripe's secure payment servers.
All credit and debit card transactions are subject to validation checks and authorization by the card issuer. In the event that the credit card payment is refused or the items you ordered are out of stock, the order will not be accepted and the Customer will be refunded.
With advance payment, you will receive an order confirmation with our bank account information. As soon as the pending order amount is received, your order will be shipped. If payment is not received within the established timeframe, unfortunately Maua Power Frame will cancel your order.
Please note that any arrangements you may have with your lender or other institutions may result in additional charges for electronic transfers, maintaining an account, etc.
DISCOUNT
From time to time, Maua Power Frame may offer promotional discount codes. Unless otherwise expressly stated, these codes can only be applied to purchases of full-price items and cannot be used in conjunction with any other offer or discount. Codes must be entered correctly at checkout to be valid. Only one discount code can be used per order and a promotional code cannot be used after an order has been placed. Discount codes cannot be used against delivery prices. Discount codes are valid only as specified at the time of issue and are subject to cancellation without notice.
DELIVERY
Maua Power Frame undertakes to send the products purchased on the Website as soon as possible, in any case within 30 working days from confirmation of payment. In the event that the sale is indicated as a "pre-order" the products will be delivered as soon as stock is available (the date of this event is indicated on the Website.
The delivery address is the one indicated by the Customer at the time the order is issued, unless otherwise agreed in writing between the parties. Under no circumstances will deliveries be made to post office boxes, mailboxes and the like. The signature of an adult is required for the collection of each delivery.
In no event does the use of this Website (including, without limitation, the ordering, sale, purchase and supply of goods through this Website) give rise to any contract between the buyer and any third party engaged by Maua PowerFrame. The Customer represents and warrants that (a) all details that it provides to the Website for the purpose of ordering and/or purchasing goods through this Website are true, accurate, current and complete in all respects, and that the credit card or of debt you use is yours and (b) you are eighteen years of age or older or you use this Website with the permission of your parent or guardian.
In the event of tampering with the package, the Customer who accepts the delivered goods without complaining to the courier of any tampering with the packaging and/or contents will assume all risks and consequences, automatically exempting both Maua Power Frame and any third parties responsible for process the order. Therefore, at the time of delivery the Customer is required to verify the perfect integrity of the package. If the package shows alterations in its packaging or obvious tampering, the Customer is asked to refuse the package from the sender without accepting the collection or opening it in front of the delivery staff and, if necessary, immediately file a complaint with the relevant written complaint to Maua PowerFrame. In all these cases, the Customer will also be invited to immediately notify Maua Power Frame via e-mail to info@mauatech.com. If the Customer decides to collect the package despite the changes, Maua Power Frame cannot be held responsible for any deficiencies in the content of the delivery.
In the event of loss/theft of an asset, Maua Power Frame, once it has received the refund request and not having found an agreement for the replacement of the lost asset, will refund only the amount advanced by the Customer as soon as possible and in any case no later than 15 working days by bank transfer to the coordinates that will be provided by the Customer. The refund will always be paid only to the person who made the payment and in no case to other parties, not even in the case of a gift to a third party.
No compensation can be charged or requested from Maua Power Frame in the event of a delay in processing the order or in delivering the goods covered by the contract. The Customer will not be able to refuse to receive the delivery except in the case of tampering, alteration or suspicion of damage to the contents caused by an obvious alteration of the package, in which case he will be asked to refuse it.
SHIPPING
Shipping is the responsibility of the Customer. We use the best couriers available and aim to dispatch your order within 5 days of stock availability, subject to credit card authorisation. The delivery address is the one indicated by the Customer at the time the order is issued, unless otherwise agreed in writing between the parties. Orders shipped to countries outside the EU may be subject to additional import taxes and customs duties. Any additional costs are the responsibility of the Customer. WARRANTY AND ASSISTANCE
All products purchased www.powerframe.bike are covered by a guarantee against defects in origin and workmanship.
The policy we offer by law is the legal guarantee, valid for two years or for the legal duration established in different countries.
Maua Power Frame guarantees the products it manufactures and/or distributes, in the first two years from purchase, for any lack of conformity. This guarantee is applicable only to the original purchaser of the product, who will be entitled, in the event of a lack of conformity, to free repair and/or replacement of the defective product.
The legal guarantee of Maua Power Frame is compatible with the legal and commercial guarantees offered by the manufacturers and distributors of the components of other commercial brands that we mount on our bicycles. In the event of a lack of conformity of these components, it will be necessary to contact these manufacturers or distributors directly for the individual guarantees of the aforementioned components.
In order to exercise this guarantee, the user must provide Maua Power Frame with a copy of the purchase document of the bicycle (sales invoice).
The user must maintain the purchased product in good condition, in accordance with the instructions and recommendations included in the bicycle instruction manual, with Maua Power Frame having the right to refuse warranty claims directly arising from a defect maintenance of the product by the user.
The warranty is not applicable in any case to breakages or defects resulting from negligent use of the bicycle, from the installation of other non-original accessories other than those supplied or mounted in the factory, from manipulation or inadequate maintenance interventions by the user or third parties in his name.
This warranty does not under any circumstances cover the normal wear and tear of the perishable elements of the product. These items subject to wear and tear are indicated in this list, by way of example and in no way restrictive. Due to the danger inherent in the use of a bicycle, both on the road and in the mountains, and the physical risks deriving from its use, this warranty refers only to the replacement of non-compliant elements and in no case covers personal damage may derive, directly or indirectly, from their failure during use. In the event of an accident, regardless of who causes it, the Maua Power Frame warranty is completely void.

RIGHT AND WITHDRAWAL
The Customer who is not satisfied with the purchase made can exercise the right of withdrawal by filling out the form at our [within 14 days from the date of receipt of the goods.
The right of withdrawal is subject to the following conditions: the products must not have been used or worn and must not show signs of wear, abrasions or scratches that could compromise the resale of the goods in "New" conditions. The products must be returned to the sender complete in all their parts, accessories in general, box, and any piece received by the Customer from Maua Power Frame.
The return must be made in a single shipment and never in separate shipments under penalty of forfeiture of the right itself.
As required by law, the returned goods travel at the risk and expense of the Customer, who is therefore asked to agree via email or telephone with Maua Power Frame the choice of the most suitable means of delivery in the case. The return shipping costs are entirely borne by the Customer who intends to exercise the right of withdrawal, except in the case of an error on the part of Maua Power Frame or third parties hired by Maua Power Frame, in which case they will be borne by them. There will be no further charges against Maua Power Frame or third parties employed by Maua Power Frame. Maua Power Frame will refuse any package for which the courier or postman requests any payment, whether for cash on delivery or shipping costs, and any type of expense.
Once your return request has been approved through our [ Return Center], you will receive shipping instructions via email. The package or gummed envelope must be appropriately sealed with signed adhesive tape in all potentially violable parts in order to make the package unique and unrepeatable.
In the event of obvious tampering with the package upon receipt as a return, it will be refused to give the Customer the possibility of compensation against the carrier and thus initiate the insurance procedure of the courier or post office.
The refund of the price paid will be made exclusively by payment to the Customer's bank or postal account within 7 working days of acceptance of the return.

Pursuant to and for the purposes of article 13 of Regulation (EU) no. 2016/679 of the European Parliament and of the Council of 27 April 2016 relating to the protection of natural persons with reference to the processing of personal data, as well as the free movement of such data (General Data Protection Regulation, hereinafter also "Regulation" or “GDPR”) and which repeals Directive 95/46/EC, we inform you that the personal data you voluntarily make available to TRA.FI.ME. SpA will be processed in compliance with current legislation on the protection of personal data and, in any case, with the principles of confidentiality which inspire the Company's activity.

Your personal data will be processed in accordance with the legislative provisions of the aforementioned legislation and the confidentiality obligations set out therein.
2) PERSONAL DATA
Personal data means any information that concerns you and is referable to you, including that indicated in the art. 9 of the Regulation, called " special categories of personal data ", such as for example data relating to health, data revealing religious or philosophical beliefs, racial or ethical origin, trade union membership, political opinions, data biometric and genetic.
Specifically, the processing in question will concern the following personal data: name, surname, telephone number, e-mail address and age group (hereinafter the "Data").
3) PURPOSE OF THE TREATMENT
The processing of your personal data will be aimed at direct marketing activities of Maua Power Frame, i.e. to send you newsletters, promotional material, commercial and/or advertising communications relating to Maua Power Frame articles produced and advertised by Maua Power Frame via automated means of e-mail, paper mail, telephone calls via operator and other information material.
4) LEGAL BASIS OF THE PROCESSING
The processing of Data for the purposes indicated in the previous point 3. finds the legal basis in your specific consent, which you are free to give or not and which may be revoked at any time.
5) PROCESSING METHODS
The personal data spontaneously provided in the context of the commercial relationship with the Data Controller, communicated directly by the interested party, will be processed using suitable paper, electronic and/or telematic tools in compliance with the regulatory provisions regarding the processing of personal data, adopting the measures of adequate security in order to guarantee the security and confidentiality of the data themselves.
The data processing will also be managed by personnel directly employed by the Maua Power Frame company and by natural or legal persons specifically identified by it as data controllers or persons in charge of processing, specifically trained and instructed.
The sending of commercial and/or advertising communications will be managed through Maua Power Frame, communication platforms for sending newsletters of the Maua Power Frame company. Following your consent to the sending of communications, your identification data will be stored on the company's servers. 6) COMMUNICATION AND DISSEMINATION OF DATA
Your Data will be communicated to well-defined subjects. In particular, within the limits strictly relevant to the purpose indicated in the previous point 3., your Data will be communicated to:
specifically authorized individuals within the Company who carry out activities connected and instrumental to the management of the requested services;
subjects that provide services for the management of the information system and telecommunications networks, including electronic mail, newsletters; third parties who collaborate with the Owner for direct marketing activities. The subjects belonging to the aforementioned categories will act as data controllers or as independent data controllers. 7) DATA STORAGE.
Your Data will be stored for a period of time not exceeding the achievement of the purposes for which they are processed, in full compliance with the principle of limitation of conservation provided for by the Regulation.
Specifically, your Data will be stored for the entire duration of the newsletter service until consent is revoked and for the duration of the requested service.
8) TRANSFER OF DATA TO THIRD PARTIES
Personal data will not be transferred to third party companies for sending their commercial communications for compensation.
9) RIGHTS OF THE INTERESTED PARTY
With reference to your Data, you have the right to ask the Company, in the manner indicated by the Regulation:
access, in the cases provided;
the rectification of inaccurate data and the integration of incomplete data;
the deletion of the Data for the foreseen reasons, such as when they are no longer necessary with respect to the purposes indicated above or are not processed in compliance with the Regulation;
the limitation of processing for the foreseen hypotheses, such as in the event that the accuracy of the Data is contested and its correctness needs to be verified;
portability, i.e. the right to receive, in the cases provided for, the Data in a structured format commonly used and readable by an automatic device and to transmit said Data to another data controller;
opposition to the treatment, in the foreseen cases.
We remind you that the sending of the newsletter can be interrupted at any time by contacting the Company, according to the methods indicated in the following point 10), which will proceed with the cancellation.

We inform you that you can exercise the rights referred to in point 9) above through the following methods:

11) COMPLAINT
If you believe that the processing of Data violates the provisions contained in the Regulation, you have the right to lodge a complaint with the Guarantor for the protection of personal data or, alternatively, lodge an appeal with the competent judicial authority.
12) TRANSFER OF DATA ABROAD
Your Data will be stored at the Company's headquarters and on servers located in the European Union.
For strictly operational needs connected with the management of marketing services, your identification data will also be communicated to suppliers in third countries. The transfer to non-EU countries, in addition to the cases in which this is guaranteed by adequacy decisions of the European Commission, will be carried out in such a way as to provide appropriate and appropriate guarantees pursuant to articles 46, 47 or 49 of the Regulation.
13) PROTECTION OF MINORS
By internal company policy, Maua Power Frame does not manage data of minors under the age of 14. Maua Power Frame will not be in any way responsible for any untrue statements that may be provided by the minor when providing personal data.
Should the declarations made by the minor be ascertained to be false, the Data Controller will immediately delete any personal data referable to them.
